Terms of Service

These Terms of Service ("Terms") govern your access to and use of JimboMesh, operated by Ingress Technology LLC ("Company," "we," "us"). By accessing or using our platform, software, or services, you agree to be bound by these Terms.

1. Definitions

  • "Holler" -- A JimboMesh node running the open source Holler Server software, capable of serving AI inference locally or via the mesh.
  • "Moonshine" -- Virtual compute credits used within the JimboMesh platform to pay for AI inference services.
  • "Operator" -- A user who runs a Holler and makes GPU compute available to the mesh.
  • "Buyer" -- A user who consumes AI inference services from Operators via the mesh.
  • "Mesh" -- The decentralized network of connected Hollers coordinated by the JimboMesh SaaS platform.
  • "Kinfolk" -- Private groups of Hollers that share compute freely among members.
  • "Platform" -- The JimboMesh SaaS services at app.jimbomesh.ai, api.jimbomesh.ai, and admin.jimbomesh.ai.

2. Open Source Software

The JimboMesh Holler Server is open source software licensed under the MIT License. Your use of the Holler Server in standalone mode is governed by the MIT License, not these Terms. These Terms apply to your use of the JimboMesh SaaS Platform and mesh services.

3. Account Registration

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials and API keys.
  • One API key corresponds to one Holler. API keys are non-transferable.
  • You must provide accurate information and keep it current.

4. Moonshine Economy

  • Moonshine tokens are virtual compute credits with no cash value outside the platform.
  • Moonshine can be earned by sharing GPU compute as an Operator or purchased directly.
  • A platform fee of 20% applies to all Moonshine transactions between Operators and Buyers.
  • Moonshine balances are non-refundable except as required by applicable law.
  • We reserve the right to adjust Moonshine pricing, exchange rates, and platform fees with 30 days notice.
  • Kinfolk group sharing is free peer-to-peer and does not incur platform fees.

5. Acceptable Use

You agree NOT to use JimboMesh to:

  • Generate, distribute, or facilitate illegal content of any kind.
  • Disguise cryptocurrency mining, botnets, or non-AI workloads as inference jobs.
  • Attempt to gain unauthorized access to other users' Hollers, accounts, or data.
  • Manipulate the Moonshine economy through fraudulent jobs, fake Hollers, or wash trading.
  • Abuse the platform's signaling infrastructure (DDoS, spam, excessive connections).
  • Reverse engineer, decompile, or attempt to extract the source code of the SaaS platform (the Holler Server is open source -- go nuts with that one).
  • Violate any applicable laws or regulations.

6. Operator Responsibilities

  • Operators are responsible for the hardware, software, electricity, and internet connectivity required to run their Holler.
  • Operators choose which models to serve and accept responsibility for the capabilities those models provide.
  • Operators should keep their Holler software updated for security and compatibility.
  • JimboMesh is not responsible for content processed on Operator hardware. Inference data travels peer-to-peer and never passes through our infrastructure.

7. Buyer Responsibilities

  • Buyers are responsible for the content of their AI requests.
  • Buyers understand that inference is performed on third-party hardware (Operators' Hollers), not JimboMesh infrastructure.
  • Buyers acknowledge that inference quality, speed, and availability depend on Operator hardware and network conditions.

8. Service Availability

JimboMesh is provided on an "as is" and "as available" basis. We do not guarantee uptime, inference speed, model availability, or Moonshine token value. The mesh is decentralized. Availability depends on participating Operators.

9. Termination

  • You may delete your account at any time. Upon deletion, your Hollers will be disconnected from the mesh and your data will be removed per our Privacy Policy.
  • We may suspend or terminate accounts that violate these Terms, with or without notice.
  • Remaining Moonshine balances on terminated accounts due to Terms violations are forfeited.
  • Termination of your SaaS account does not affect your right to use the open source Holler Server in standalone mode under the MIT License.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INGRESS TECHNOLOGY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF JIMBOMESH, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA, LOSS OF PROFITS, HARDWARE DAMAGE, OR INTERRUPTION OF SERVICE.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ingress Technology LLC from any claims, damages, or expenses arising from your use of JimboMesh, your violation of these Terms, or your violation of any third-party rights.

12. Intellectual Property

  • The JimboMesh Holler Server source code is licensed under MIT. You retain all rights granted by that license.
  • The JimboMesh SaaS platform, branding, logos, "Moonshine," "Holler," and "Kinfolk" names are trademarks of Ingress Technology LLC.
  • You retain ownership of all content you process through your Holler. We claim no rights to your data.

13. Dispute Resolution

These Terms are governed by the laws of the State of Colorado, USA. Any disputes shall be resolved through binding arbitration in Douglas County, Colorado, except that either party may seek injunctive relief in court for intellectual property violations or security breaches.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use after changes constitutes acceptance.
